Preamble

These legal notices are issued by REAKORD SAS, a simplified joint-stock company (Société par Actions Simplifiée) with share capital of €41,040, registered with the Beauvais Trade and Companies Register under SIRET number 98776034500015, whose registered office is located at 2 rue des Grès Valois, 60240 Montagny-en-Vexin, France. The company publishes and operates the mobile application called “REAKORD” (hereinafter the “Application”), available on iOS and Android stores, as well as the website accessible at https://www.reakord.com (hereinafter the “Site”).

Article 2 - Hosting

The Site is hosted by a specialized provider whose full details are available upon simple request to REAKORD SAS. The Application is hosted using the infrastructures of the Apple App Store and Google Play Store platforms.

Article 3 - Intellectual Property

All elements composing the Application and the Site (texts, graphics, logos, trademarks, videos, sounds, databases, etc.) are protected by intellectual property law and remain the exclusive property of REAKORD SAS or its partners. Any reproduction, representation, modification, adaptation, or exploitation, whether in whole or in part, by any means whatsoever, without prior written authorization, is strictly prohibited and may constitute an act of infringement engaging the civil and criminal liability of the offender.

Article 4 - Liability

The publisher of the Application and the Site makes every effort to ensure the accuracy and updating of the information provided. However, no guarantee is given as to the accuracy, completeness, or updating of the content. Use of the Application and the Site is under the sole responsibility of the User. REAKORD SAS cannot be held liable for direct or indirect, material or immaterial damages resulting from the use of the Application or the Site, including in cases of interruption, suspension, malfunction, or errors.

Article 5 - Personal Data

In the context of using the Application and the Site, REAKORD SAS may collect and process certain personal data of Users, in accordance with applicable regulations, including the General Data Protection Regulation (GDPR) and the amended French Data Protection Act. The methods of collection, processing, and the exercise of Users' rights are detailed in the Application's Privacy Policy, accessible from the Application and the Site.

Article 5 bis - Reference to Terms & Conditions

For further information regarding the conditions of use of the Application, the responsibilities of Users and REAKORD SAS, as well as the rules applicable to future transactions, please refer to the General Terms of Use (CGU) and the General Terms of Sale (CGV). These contractual documents prevail over this legal notice in the event of any contradiction.

Article 6 - Governing Law and Jurisdiction

This legal notice is governed by French law. In the event of a dispute relating to the interpretation, validity, or performance of these terms, exclusive jurisdiction is granted to the competent French courts, unless mandatory jurisdictional rules to the contrary are provided by European or international law.
